These Terms & Conditions (“Terms”) apply to your use of berganco.com (the “Site”) and to communications you receive from Bergan & Company (registered brand name: Bergan and Company; “we,” “us,” or “our”), a residential property management company located at 7375 E Peakview Ave, Centennial, CO 80111. By using the Site or opting in to our communications you agree to these Terms and to our Privacy Policy.

Use of the Site

The Site provides information about our property management services, available rentals, and ways to contact our office. Content on the Site is provided for general information only and does not constitute legal, financial, or real estate advice. Rental listings, pricing, and availability are subject to change without notice.

You agree not to misuse the Site, including by submitting false information through our forms, attempting to interfere with the Site's operation, or using automated means to collect information from it.

Forms and Inquiries

When you submit a form on the Site we use the information you provide to respond to your request. Submitting a form does not create a lease, management agreement, or other binding relationship; those are governed by their own signed documents.

Intellectual Property

The Site and its content, including text, images, logos, and design, are owned by or licensed to Bergan & Company and may not be copied or reused without our written permission.

Third-Party Links and Services

The Site may link to third-party sites and services, such as our resident and owner portals and rental application provider. We are not responsible for the content or practices of those sites.

Disclaimer and Limitation of Liability

The Site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Bergan & Company is not liable for any indirect, incidental, or consequential damages arising from your use of the Site.

SMS Terms

These SMS Terms (“SMS Terms”) govern text messages sent by Bergan & Company (registered brand name: Bergan and Company; “we,” “us,” or “our”) to your mobile phone. By opting in to receive text messages from us, you agree to these SMS Terms and to our Privacy Policy.

Program description

Bergan & Company sends informational and customer-care text messages to residents, property owners, and people who have contacted our office. Messages may include:

• Maintenance request confirmations, approvals, and status updates
• Work order and vendor scheduling information
• Links to track a request or upload photos
• Approval requests and reminders for property owners
• Move-in, lease, and resident portal information
• Account notifications and reminders
• Replies to questions or requests you send us

We do not send promotional or marketing messages under this program.

How to opt in

You can opt in to receive text messages by:

• Checking the text-messaging consent box on a form at berganco.com
• Agreeing to the Text Message Communications clause in your lease or move-in paperwork (view the clause)
• Agreeing to the Text Message Communications clause in your property management agreement (view the clause)

If you text our office with a question, we will reply to that message; replies to your own inquiry are not a subscription to recurring messages.

Consent to receive text messages is not a condition of renting, applying, or receiving any service from Bergan & Company.

Message frequency

Message frequency varies. How many messages you receive depends on activity on your account.

Cost

Message and data rates may apply. Charges are billed by your mobile carrier according to your plan. Contact your carrier for details.

How to opt out

Reply STOP to any message from us to cancel. You will receive a single confirmation text and no further messages from that number. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT.

To resubscribe, reply START to the same number.

Opting out of text messages does not affect your lease, management agreement, or other communications from us by email, phone, or mail.

Supported carriers

Messages are supported on major U.S. carriers, including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.

Governing Law
