This Privacy Policy explains how we collect, use, and share information when you visit berganco.com (the “Site”), contact our office, apply to rent a property we manage, live in a property we manage, or engage us to manage your property (together, the “Services”).

Information We Collect

Information you provide to us

• Contact details such as your name, email address, mailing address, and phone number (including mobile number) when you submit a form on the Site, call or text our office, apply for a rental, sign a lease, or sign a property management agreement.
• Rental application information such as employment, income, rental history, and identification, which may be collected through our application provider.
• Property and account information for owners, including property addresses, banking details for disbursements, and tax identification information.
• Maintenance requests, messages, photos, and other content you send us.
• Communication preferences, including whether you have agreed to receive text messages.

Information collected automatically

• Device and usage information such as IP address, browser type, pages viewed, and referring URL, collected through cookies and similar technologies when you visit the Site.

Information from other sources

• Consumer reporting agencies and screening providers (for rental applicants, with your authorization).
• Our property management software and portal providers, and publicly available sources.

How We Use Information

We use the information we collect to:

• Process rental applications, leases, rent payments, and owner disbursements.
• Coordinate, schedule, and communicate about maintenance and repairs.
• Send account notifications, reminders, and service updates by email, phone, and (with your consent) text message.
• Operate, maintain, secure, and improve the Site and our Services.
• Comply with legal obligations, enforce our agreements, and protect the rights and safety of our residents, owners, staff, and others.

Text Messaging (SMS)

If you provide your mobile number and agree to receive text messages, Bergan & Company may send you SMS messages related to your inquiry, application, tenancy, or property, including maintenance request confirmations and updates, work order and vendor scheduling information, approval requests and reminders, move-in and resident portal information, account notifications, and replies to questions you send us.

• Consent. You opt in by checking the text-messaging consent box on one of our forms, by agreeing to the Text Message Communications clause in your lease or property management agreement (view the clause). Consent to receive text messages is not a condition of renting a property, applying, or receiving any service from us.
• Frequency. Message frequency varies.
• Cost. Message and data rates may apply according to your mobile carrier plan.
• Opt out. Reply STOP to any message to stop receiving texts from us. You will receive one final confirmation message. Reply START to resubscribe.
• Help. Reply HELP to any message, call us at (303) 694-5116, or email berganrealty@berganco.com.
• Carriers are not liable for delayed or undelivered messages.

How We Share Information

We share information only as described here:

• Service providers that perform services on our behalf, such as property management software, resident and owner portals, payment processors, tenant screening providers, maintenance vendors and contractors, communications providers that deliver our calls, emails and text messages, and website hosting and analytics providers. These providers may use your information only to provide services to us.
• Property owners and residents as needed to manage the property. For example, we may share a resident's maintenance request with the owner of the property, or share a vendor's scheduling information with a resident.
• Legal and safety purposes, such as complying with a subpoena, court order, or other legal process, enforcing our agreements, or protecting the rights, property, or safety of Bergan & Company, our residents, owners, staff, or others.
• Business transfers in connection with a merger, acquisition, or sale of all or part of our business.

We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except as necessary for the communications providers that deliver our messages on our behalf.

Cookies and Analytics

The Site uses cookies and similar technologies to operate the Site and understand how it is used. We use Google Analytics to measure Site traffic and Google Ads conversion and remarketing tags to measure and improve our advertising; these services may set their own cookies and collect usage data under Google's privacy policy. We retain information for as long as needed to provide the Services, comply with legal, tax, and accounting requirements (including Colorado landlord-tenant record-keeping requirements), resolve disputes, and enforce our agreements. SMS consent records are retained for as long as you are subscribed and for a reasonable period afterward to document your preferences.

We use reasonable administrative, technical, and physical safeguards designed to protect the information we hold. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your Choices

• Text messages: reply STOP to any message, or contact us using the details below.
• Email: use the unsubscribe link in any non-transactional email, or contact us.
• Access and correction: contact us to review or update the contact information we hold about you.

Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.
